1. Agreement to Terms
These Terms and Conditions (“Terms”) form a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and Arkan Palm For Real Estate Investment, doing business as Arkan Palm (“Arkan Palm”, “we”, “us”, or “our”), concerning your access to and use of https://www.arkanpalm.com, as well as any other related media form, mobile website, or mobile application connected to it (collectively, the “Site”). We are registered in Egypt and have our registered office at Arkan Plaza – Al Bostan St. | building 5 – floor 3.
By accessing the Site, you confirm that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Site and must discontinue use immediately.
We reserve the right to make changes to these Terms at any time. We will alert you by updating the “Last updated” date, and your continued use of the Site after any revisions are posted constitutes acceptance of the changes. We recommend checking this page each time you use the Site.
Users who are minors in their jurisdiction of residence (generally under 18) must have the permission of, and be supervised by, a parent or legal guardian to use the Site.
2. Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”), along with the trademarks, service marks, and logos contained within it (the “Marks”), are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and other intellectual property rights.

If you provide any information that is untrue, inaccurate, or incomplete, we reserve the right to suspend or terminate your account and refuse any current or future use of the Site.
4. User Registration
You may be required to register to use the Site. You agree to keep your password confidential and are responsible for all use of your account. We reserve the right to remove, reclaim, or change a username if we determine, in our sole discretion, that it is inappropriate, obscene, or otherwise objectionable.
5. Prohibited Activities
You may not access or use the Site for any purpose other than that for which we make it available. As a user, you agree not to:
- Systematically retrieve data or content from the Site to create or compile a collection or database without our written permission.
- Trick, defraud, or mislead us or other users, particularly when attempting to learn sensitive account information such as passwords.

- Delete the copyright or other proprietary rights notice from any Content, or attempt to impersonate another user or person.
- Attempt to bypass any measures designed to prevent or restrict access to the Site.
- Decipher, decompile, disassemble, or reverse engineer any part of the Site, except as permitted by law.
- Use a buying agent or purchasing agent to make purchases on the Site, where applicable.
- Use the Site as part of any effort to compete with us, or otherwise use the Site or its Content for any revenue-generating purpose outside its intended use.
6. User-Generated Contributions
The Site may allow you to create, submit, post, or otherwise make available content such as text, comments, suggestions, or other materials (collectively, “Contributions”). By making any Contribution available, you represent and warrant that: your Contribution does not infringe the intellectual property or other rights of any third party; you own or have the necessary rights and permissions to use and authorize us to use your Contribution; your Contribution is not false, misleading, obscene, harassing, or otherwise objectionable; and your Contribution does not violate any applicable law, regulation, or the rights of any third party.
Any use of the Site in violation of the foregoing may result in termination or suspension of your rights to use the Site.
7. Contribution License
You agree that we may access, store, process, and use any information and personal data you provide in accordance with the terms of our Privacy Policy. We do not assert ownership over your Contributions. You retain full ownership of all of your Contributions and any related intellectual property rights. However, by submitting suggestions or feedback regarding the Site, you agree that we may use and share that feedback for any purpose without compensation to you.
8. Submissions
You acknowledge that any questions, comments, suggestions, or other information regarding the Site that you provide to us are non-confidential and become our sole property. We are entitled to the unrestricted use of these submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.
9. Third-Party Websites and Content
The Site may contain links to other websites (“Third-Party Websites”) as well as content originating from third parties (“Third-Party Content”). Such Third-Party Websites and Content are not investigated or monitored by us, and we are not responsible for their accuracy, offensiveness, opinions, reliability, or privacy practices. Inclusion of, or linking to, any Third-Party Website or Content does not imply our approval or endorsement of it. If you decide to access any Third-Party Website, you do so entirely at your own risk.
10. Site Management
We reserve the right, but not the obligation, to monitor the Site for violations of these Terms, take appropriate legal action against anyone who violates the law or these Terms, refuse, restrict, or disable access to any Contributions, and otherwise manage the Site in a manner designed to protect our rights and property and to facilitate its proper functioning.
11. Privacy Policy
We care about data privacy and security. Please review our Privacy Policy, which is incorporated into these Terms by reference. Please be advised the Site is hosted in Egypt. If you access the Site from another region with data protection laws that differ from those of Egypt, by continuing to use the Site you agree to have your data transferred to and processed in Egypt.
12. Term and Termination
These Terms remain in full force and effect while you use the Site. We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Site to any person for any reason, including for breach of any provision of these Terms. We may terminate your use or delete your account and any related content at any time, without warning, in our sole discretion.
13. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion, without notice. We cannot guarantee the Site will be available at all times and will not be liable for any loss, damage, or inconvenience caused by your inability to access the Site during any downtime or discontinuance.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Egypt. Arkan Palm For Real Estate Investment and you irrevocably agree that the courts of Egypt shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Terms.
15. Dispute Resolution
To expedite resolution and control the cost of any dispute related to these Terms, both you and we agree to first attempt to negotiate any dispute informally for at least thirty (30) days before pursuing formal proceedings. If the dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the courts identified in the Governing Law section above. Any such proceeding will be conducted on an individual basis, and not as part of any class or representative action.
16. Corrections
There may be information on the Site that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any such errors and to update the information on the Site at any time, without prior notice.
17. Disclaimer
The Site is provided on an “as is” and “as available” basis. Your use of the Site will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Site, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty as to the accuracy or completeness of the Site’s content, and will not be liable for any errors, interruptions, unauthorized access to our servers, or any bugs or viruses transmitted through the Site by any third party.
18. Limitation of Liability
In no event will Arkan Palm For Real Estate Investment, or its directors, employees, or agents, be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits or lost revenue, arising from your use of the Site, even if we have been advised of the possibility of such damages.
19. Indemnification
You agree to defend, indemnify, and hold us harmless, including our affiliates and our respective officers, agents, and employees, from any loss, damage, or claim, including reasonable attorneys’ fees, arising out of your use of the Site, your breach of these Terms, or your violation of the rights of any third party.
20. User Data
We will maintain certain data that you transmit to the Site for the purpose of managing its performance. Although we perform regular backups, you are solely responsible for all data you transmit, and we shall have no liability to you for any loss or corruption of such data.
21. Electronic Communications, Transactions, and Signatures
Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and agree that all agreements, notices, and disclosures we provide electronically satisfy any legal requirement that such communications be in writing.
22. Your Regional Consumer Rights
Depending on where you reside, you may have additional consumer protection rights under local law regarding complaints, refunds, or dispute resolution that are not superseded by these Terms. Nothing in these Terms is intended to limit any non-waivable statutory rights you may hold.
23. Miscellaneous
These Terms and any policies posted by us constitute the entire agreement between you and us. Our failure to enforce any right or provision of these Terms shall not operate as a waiver of that right. If any provision of these Terms is found to be unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect. No joint venture, partnership, employment, or agency relationship is created between you and us as a result of these Terms.
